This Website is not a media organisation.
Terms and Definitions
Website is located at https://kes.com.ua/.
Web administrator (representative of the Website / Website Owner) – a person authorised by the website owner to act under the Agreement.
User – any person who visited the Website and stayed there, using its features to see its content.
Personal data – information provided by the User when interacting with the Website, in accordance with this Agreement and applicable law.
Agreement – this Agreement as subsequently amended.
1. General provisions.
1.1. This Agreement is an offer of terms of use of the Website between the Website Master and the User. The Agreement regulates the procedure for the User’s access to resources, services and features of the Website provided by the Web administrator.
1.2. Only the User who has accepted all the terms of this Agreement is allowed to access the Website. The User is obliged to read the Agreement before accessing the Website carefully.
1.3. By accessing any part of the Website, the User agrees to be bound by the terms of this Agreement.
1.4. If a person disagrees with the terms of this Agreement (in whole or part), the person is not granted the status and rights of the User and is prohibited from using the Website and any information posted on it.
1.5. It is forbidden to use the Website for persons under 18 years. The Web administrator takes security issues seriously, especially when it comes to minors. Therefore, we ask parents to explain to children the problem of Internet security and the purpose of using this Website.
1.6. The Website’s content is protected by copyright in accordance with the laws of Ukraine and international copyright. No one other than the Web administrator has the right to modify, publish, transmit, participate in the transfer or sale, recreate, create new content, distribute, perform or in any other way use the content of the site (including software) in whole or in part.
2. Rights and responsibilities of Users and Web Administrator.
2.1. When using the Website, the User and the Administrator undertake to comply with the legislation of Ukraine and this Agreement.
2.2. Rights and responsibilities of the User.
2.2.1. The User has the right to access, use and download information from the Website exclusively for personal non-commercial use;
2.2.2. The User is not entitled to use the Website to carry out any activity that has the purpose of making a profit (except for activities separately stipulated by agreements between the User and the Administrator);
2.2.3. The User is prohibited from using information from the Website on other sites, resources and/or computer networks without reference to the Website as a source of such information;
2.2.4. The User has no right to collect information about other Users, including personal and contact data (personal data);
2.2.5. The User is prohibited from uploading computer viruses and/or software that could interrupt or disrupt the standard functionality of any computer hardware and software, as well as any means of telecommunications;
2.2.6. The User is prohibited from attempting to bypass the security technologies of the Website;
2.2.7. The User is not allowed to use the tools to influence traffic, as well as to distribute any advertising or spam;
2.2.8. The User may not use the Website for any purpose not provided for in this Agreement.
2.3. Rights and responsibilities of the Administrator.
2.3.1. The Administrator has the right to:
2.3.1.1. review the statistics of the Website;
2.3.1.2. terminate and restrict access to the Website of the User who violated the terms of use;
2.3.1.3. make changes to this Agreement without prior notice and consent of the Users;
2.3.1.4. determine the content and design of the Website.
2.3.2. The Administrator undertakes to:
2.3.2.1. maintain Website properly, except in cases where this is not possible due to technical issues;
2.3.2.2. ensure that the content of the Website does not contradict the legislation of Ukraine and does not discriminate against persons on the grounds of sex, race, colour, political, religious and other beliefs, age, disability, ethnic and social origin, marital and property status, place of residence, language-specific or other grounds.
3. Final provisions.
3.1. This Agreement is an open and publicly available document, binding on all Users of the Website and the Administrator.
3.2. The Administrator unilaterally has the right to change and supplement the terms of this Agreement. The Administrator is not obliged to notify the Users of any changes or additions to this Agreement.
3.3. Amendments to this Agreement shall enter into force upon their publication on this Website.
3.4. The User is recommended to check and review the provisions of this Agreement for amendments and supplements to the terms of use of the Website. The responsibility for this lies with the User.
3.5. The Agreement shall not be terminated if one or more of its provisions become temporarily or permanently invalid due to particular circumstances.
3.6. This Agreement shall enter into force upon acceptance by the User of the terms of this Agreement confirmed by the fact of using the Website and shall remain in force until its full implementation by the Administrator and the User.
3.7. Any disputes arising out of this Agreement shall be settled through negotiations between the Administrator and the User. If the dispute has not been resolved through negotiations, such a dispute must be referred to court, under the relevant jurisdiction and cognisance under the laws of Ukraine.
